Terms of Service (Public Offer)

This document is a formal offer to the public (a public offer) by Individual Entrepreneur Alyukova (Business Identification Number (BIN): 001028600202), referred to below as the Provider. It sets out all essential terms of the agreement for services providing access to a digital product.

In accordance with Article 395, paragraph 1, of the Civil Code of the Republic of Kazakhstan, payment for the Provider's services by the Customer constitutes acceptance of this offer.

1. General provisions

1.1. This public offer governs the relationship between the Provider and individuals (each referred to as the Customer) who purchase the digital product.

1.2. By making payment, the Customer confirms that they:

• Have read the terms of this offer;
• Understand the contents and scope of the product they are purchasing;
• Accept all terms of the offer without reservation.

1.3. There are no age restrictions on purchasing the digital product.

2. The digital product

2.1. The Provider gives the Customer access to Designer Pack, a digital design resource pack containing graphic assets, templates, design elements and other digital files in Figma and/or other digital formats.

2.2. The product is delivered electronically by providing access to the files or a download link once payment has been confirmed.

2.3. The digital product is not a training course, a consulting service or a subscription.

3. Ordering and payment

3.1. The price of the digital product is displayed on the Provider's website. The applicable price is the price shown at the time of payment.

3.2. Payments are made electronically using one of the available options:

• Tribute — payment through Telegram;
• Kaspi Bank — for customers in Kazakhstan;
• Robokassa — online payment;
• Contact support to ask about alternative payment methods.

3.3. The payment service provider may automatically convert the payment currency in accordance with the terms of the Customer's bank.

3.4. The Provider's obligation to provide access is fulfilled when the Customer is given access to the digital product.

4. Access to the product

4.1. Access to the digital product is provided automatically or manually after successful payment has been confirmed.

4.2. The Provider is not responsible for access problems caused by circumstances beyond its control, including:

• Incorrect contact details supplied by the Customer;
• Restrictions or outages affecting third-party services, including Figma;
• Technical problems on the Customer's side.

5. Refunds

5.1. The product is a digital good supplied electronically.

5.2. In accordance with the laws of the Republic of Kazakhstan, no refund is provided once access to the digital product has been granted, except where a technical issue caused by the Provider prevents the Customer from accessing the product.

5.3. If the Customer encounters technical problems, they may contact the Provider to have those problems resolved.

6. Rights and obligations

6.1. The Provider must:

• Provide the Customer with access to the digital product after payment;
• Ensure that the supplied materials function correctly at the time of delivery.

6.2. The Provider may:

• Change the contents of the digital product without reducing its quality;
• Refuse to provide services if the terms of this offer are breached.

6.3. The Customer must:

• Use the digital product only for lawful purposes;
• Not transfer, distribute or resell the digital product to third parties.

7. Limitation of liability

7.1. The Provider is not responsible for:

• Commercial or financial results from using the digital product;
• The product not meeting the Customer's subjective expectations;
• Losses resulting from incorrect use of the materials.

7.2. The Provider's maximum liability is limited to the amount actually paid by the Customer.

8. Final provisions

8.1. This offer takes effect when published on the Provider's website and remains in effect indefinitely.

8.2. The Provider may change the terms of this offer at any time without prior notice to the Customer.

8.3. All disputes and disagreements are to be resolved in accordance with the laws of the Republic of Kazakhstan.
